For patents, there is a penalty for marking something as patented when
it is not.  For copyright, there is no penalty for marking the
copyright wrong on the item.  You can find exact reprints of hundred
year old books, without any new improved intros or anything new, and
they are marked copyright 2013.  It's dirty, but it's permissible to
lie.
