Good morning, everyone.

We license a couple of historic primary source archival collections
through Gale/Cengage.  We are considering purchasing the 19th Century
US Newspapers collection but are disconcerted to find that
Gale/Cengage has altered their contract template to prohibit ILL.  Our
rep has informed us that without this new prohibitive language, ILL
would be permitted under copyright law and would allow libraries to
share material beyond the “minimal, insubstantial portions” they’ve
allowed in the past.  They are also concerned that ILL would allow the
receiving library to keep materials for multiple users.  ILL seems
like a standard practice among libraries, and as a major player in the
publishing/vending world, Gale/Cengage’s new contract language is
surprising.

Has anyone else encountered these new ILL limitations in Gale/Cengage
contracts?  Have you negotiated for ILL successfully?  Or are you
going ahead and purchasing/subscribing to collections anyway?
