Hello all.

Has anyone signed on with the videostreaming service Criterion on
Demand and would be willing to share their insights? Criterion
presented us with a Subscription Agreement for it (it’s more or less
identical to what is on
http://www.criterionondemand.com/terms-and-conditions), and we have
some big concerns about the document, including:

- us having to host some of their content but them getting to
pre-approve any third party we may use to do that?

- them entitled to damages/relief “without the necessity of proving damages”?

- “Submissions”: first, what submissions are they referring to; then,
we must evaluate our users’ submissions for content (how?); and
finally, Criterion gets perpetual licence to use our users’
submissions as they wish?

- changes to Terms of Use and Termination with warning/notification or
chance for us to remedy the situation?

- the “Arbitration” provision: they can take legal action against us,
but we can’t against them; and if we do, they can get fees and costs
from us?
