Here is the TDM language that Taylor & Francis includes (by request) in our licenses:

Definition: Data Mining  - A machine process by which information may be derived by identifying patterns and trends within natural language through text categorization, statistical pattern recognition, concept or sentiment extraction, and the association of natural language with indexing terms.

Clause to be inserted:   Licensee will make diligent efforts to inform users that they must obtain advance notice to perform and engage in text/data mining activities, permission for which shall not be unreasonably withheld by Publisher provided that Authorized Users are engaging in text/data mining activities for legitimate  academic research and other education purposes.

The reason we ask for advance notice is best explained by a TDM project we have underway.  A group of climate scientists in Norway approached us with a text and data mining proposal.  We are working with them to identify the relevant content and to help them to understand our data structures so that they can get the most out of their project.

This means that we were able to ensure that they were able to extract the data in the appropriate format, and at a rate that is manageable for them and in a way that does not distort our usage statistics or impact on system performance. We then proposed to write-up the project with them, in order to share any lessons learned and to encourage other similar projects.

If they had not approached us in advance, then they would probably have triggered our robot-detection systems, resulting in a temporary IP block. If they had succeeded in downloading the data then it would probably have been a very broad selection and their institution’s usage statistics would have been artificially inflated. This would have been an unsatisfactory experience for all concerned instead of being a win-win for all parties.

Put simply, advance notice of TDM requests is intended to result in a satisfying experience for all parties which is why we require the wording referenced above.
